On June 15, 2012, the Secretary of Homeland Security announced that certain people who came to the United States as children and meet several key guidelines may request deferred action for a period of two years, with the possibility of renewal, and become eligible for work authorization. Deferred action is a discretionary decision to defer removal actions for certain individuals as an exercise of prosecutorial discretion. Deferred action, however, does not provide an individual with any permanent, lawful status.

Provisional Waivers

The provisional waiver process allows individuals, who only require waivers because of accrued unlawful presence in the U.S., to file waiver applications in the U.S. and have these waiver applications adjudicated prior to their departure from the U.S. to attend an immigrant visa interview at a U.S. embassy or consulate abroad.
